Mr. Burgess’ practice is centered on the law of commercial and residential real estate and banking law. He has assisted both individuals and corporate clients in all phases of real estate acquisition, drafting purchase agreements, option agreements, shopping center leases, triple-net leases, leases with options to purchase, and the formation of condominiums, including drafting condominium declarations and formation of owner associations. He has represented various banks in numerous commercial and residential loan transactions, ranging from conventional, FHA, and VA financing to commercial defeasance, revolving floor-plan financing, development financing, construction financing, tax-deferred exchanges under Section 1031 of the Internal Revenue Code, and various other real estate and asset-based financing. He has also aided in litigating various matters concerning real estate, including representation of individuals in condemnation proceedings, acquisition contract disputes, and construction contract disputes.
